TOPEKA — An Overland Park sporting goods store has reached a settlement with the federal government over violations of the Americans with Disabilities Act and has agreed to change its policies.

The allegation against Scheels All Sports stems from a complaint filed in 2019 by an 18-year-old woman with Down syndrome. An investigation by the U.S. attorney’s office found that an employee denied a woman a ride on a Ferris wheel during a high school ride, citing company policy that prohibits disabled riders without an adult.

“Scheels’ former policies and practices were inconsistent with the ADA, which prohibits eligibility criteria that limit the full and equal enjoyment of goods and services by persons with disabilities,” said Acting U.S. Attorney Duston Slinkard. “Furthermore, any screening policy should be based on legitimate safety requirements and not on simple assumptions, stereotypes, or generalizations about people with disabilities.”

Scheels’ new policy prohibits discrimination against people with disabilities and any criteria that exclude people with disabilities. According to the settlement, Scheels must pay $1,000 in restitution to the complainant and develop additional policies to ensure that employees comply with the ADA.
